These Terms of Service (“Terms”) constitute an agreement between you and Crafty Tech S.R.L. (“Crafty Tech,” “we,” “us,” or “our”) regarding your use of the VPN CIRCLE mobile application and related virtual private network services, features, and functionality (collectively, the “Service”).

Please read these Terms carefully before using VPN CIRCLE. By downloading, installing, accessing, or using VPN CIRCLE, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Service.

VPN CIRCLE is designed to provide users with a convenient way to establish a virtual private network connection and enhance the privacy and security of their internet connection.

1. Use of the Service

You may use VPN CIRCLE only for lawful purposes and in accordance with these Terms.

You agree not to use the Service to:

● violate any applicable local, national, or international laws or regulations;

● engage in fraudulent, abusive, or deceptive activities;

● gain unauthorized access to computers, systems, networks, or accounts;

● conduct hacking, cracking, or unauthorized security testing;

● distribute malware, viruses, ransomware, or other malicious software;

● perform port scanning or unauthorized network scanning;

● conduct denial-of-service or distributed denial-of-service attacks;

● intentionally interfere with or disrupt networks, systems, or other users;

● send spam or other unsolicited bulk communications;

● use the Service to facilitate criminal activities;

● attempt to circumvent technical restrictions or security measures of the Service;

● use the Service in a manner that could damage, overload, or negatively affect the Service or other users.

You are solely responsible for your use of the Service and for ensuring that your activities comply with applicable laws and regulations.

2. Prohibited Activities

VPN CIRCLE must not be used to facilitate activities that are illegal, fraudulent, harmful, abusive, or intended to compromise the security or availability of third-party systems or networks.

We reserve the right to restrict, suspend, or terminate access to the Service where we reasonably believe that the Service is being used in violation of these Terms, applicable law, or in a manner that may compromise the security, stability, or availability of the Service.

3. Fair Use

VPN CIRCLE does not intentionally impose a fixed bandwidth or data allowance on users unless otherwise stated in the applicable subscription or service description.

However, the Service is subject to reasonable and fair use.

Activities that generate excessive or abnormal network traffic, automated connections, repeated connection attempts, or other activity that places an unreasonable load on the VPN infrastructure may be restricted.

We may temporarily limit or suspend access to the Service when necessary to protect the stability, security, and availability of the network for all users.

4. Service Availability and Performance

We aim to make VPN CIRCLE available as consistently as reasonably possible. However, uninterrupted availability cannot be guaranteed.

The Service may be temporarily unavailable or interrupted due to:

● scheduled maintenance;

● technical problems;

● network failures;

● infrastructure or hosting issues;

● failures of third-party service providers;

● telecommunications or internet disruptions;

● security incidents;

● emergencies;

● circumstances beyond our reasonable control.

VPN connection speed, latency, reliability, and availability may vary depending on factors including your location, selected VPN server, internet connection, network congestion, device configuration, and other technical conditions.

We do not guarantee a specific connection speed, latency, availability, or performance level.

5. VPN Connections

VPN CIRCLE provides access to VPN servers and infrastructure that may be located in different countries or regions.

The availability of particular VPN locations may change over time. We may add, remove, replace, or temporarily disable VPN servers or locations when necessary to maintain or improve the Service.

Connection quality and performance may vary between locations.

We do not guarantee that every VPN location will always be available.

6. User Responsibility

You are responsible for using VPN CIRCLE in a secure and lawful manner.

You are responsible for the activity conducted through your device and VPN connection.

VPN CIRCLE does not make you anonymous or immune from legal obligations. Using a VPN does not guarantee complete anonymity or protection against all online threats.

You should continue to use appropriate security practices, including maintaining updated software, using strong passwords, and avoiding suspicious websites, files, and communications.

7. Privacy

Your privacy is important to us.

Our collection and use of information in connection with VPN CIRCLE are described in our Privacy Policy.

8. Advertising

VPN CIRCLE may display advertisements through third-party advertising services, including Google Mobile Ads (AdMob).

Advertisements may be displayed within the application in accordance with applicable laws, platform requirements, and the relevant advertising provider's policies.

The use of advertising services is subject to the practices described in our Privacy Policy.

9. Subscriptions and Purchases

Certain features or functionality of VPN CIRCLE may be available through paid subscriptions or other in-app purchases.

Where a subscription is offered, the applicable price, billing period, and features will be presented to you before purchase.

Purchases made through the App Store are processed by Apple and are subject to Apple's applicable terms and conditions.

Subscriptions may automatically renew unless canceled in accordance with Apple's subscription management rules.

You can manage or cancel subscriptions through your Apple Account settings.

We do not receive or store your complete payment card information.

10. Intellectual Property

VPN CIRCLE, including its software, design, graphics, trademarks, logos, interfaces, text, and other original materials, is owned by or licensed to Crafty Tech S.R.L. and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to use VPN CIRCLE for your personal, lawful use in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application except where such restriction is prohibited by applicable law.

11. Third-Party Services

VPN CIRCLE may rely on third-party services and infrastructure to provide certain functionality, including payment processing, advertising, hosting, networking, or other technical services.

Your use of third-party services may be subject to the terms and privacy policies of those third parties.

We are not responsible for the availability, functionality, security, or policies of third-party services that are outside our reasonable control.

12. Suspension and Termination

We may temporarily suspend or restrict access to VPN CIRCLE where necessary to:

● protect the security or stability of the Service;

● investigate suspected abuse or violations of these Terms;

● comply with applicable law;

● prevent activity that may negatively affect other users or our infrastructure.

You may stop using VPN CIRCLE at any time by uninstalling the application from your device.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, VPN CIRCLE and the Service are provided on an “as is” and “as available” basis.

We do not guarantee that the Service will:

● always be available or uninterrupted;

● be free from errors or defects;

● provide a particular connection speed or performance;

● protect against every possible online security threat;

● be compatible with every device, network, website, or online service.

Your use of VPN CIRCLE is at your own discretion and risk.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Crafty Tech S.R.L. shall not be responsible for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, VPN CIRCLE.

This includes, where permitted by law, loss of data, loss of profits, service interruptions, or other damages resulting from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

15. Changes to the Service

We may modify, update, improve, suspend, or discontinue parts of VPN CIRCLE or the Service from time to time.

We may introduce new features, remove existing features, change VPN locations, modify technical infrastructure, or make other changes necessary to maintain and improve the Service.

Where required, material changes will be communicated through appropriate channels.

16. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to VPN CIRCLE, our services, legal requirements, or our business practices.

When we make changes, we will update the “Last Updated” date at the beginning of these Terms.

Your continued use of VPN CIRCLE after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

These Terms shall be governed by and interpreted in accordance with the applicable laws governing Crafty Tech S.R.L., except where mandatory consumer protection laws provide otherwise.

Nothing in these Terms is intended to limit any rights that you may have under mandatory consumer protection laws applicable in your jurisdiction.
